LinkedIn Allegedly Violates Fair Credit Reporting Act with Reference Search Service


LinkedIn, the eleven-year-old social networking site for professionals and business persons, has been sued because a feature it has added to its service. The lawsuit has been filed as a class action in California.

The lawsuit complains of a feature called Reference Search. The feature provides users with a list of people who might be job candidates. The LinkedIn user can contact the people on the list using InMail, LinkedIn’s email service. The complaint alleges that, by providing job reference material to prospective employers, LinkedIn enables these employers to dig through the employment history of a LinkedIn member without ensuring that the material is accurate, thus violating the Fair Credit Reporting Act.

LinkedIn says that it takes member privacy very seriously and plans to vigorously fight the lawsuit.
